Terms of Sale

These Terms of Sale are between you and TidalCore LLC ("we," "us," or "our") and govern purchases you make on hydrosling.vercel.app. TidalCore LLC is based in San Clemente, California. By placing an order, you agree to these Terms, along with our Privacy Policy, Shipping Policy, Returns & Refunds, and Accessibility Statement.

1. Products and intended use

HydroSling™ is a water-friendly arm-support accessory — not a medical device, rehabilitation device, flotation device, life-saving device, or substitute for a physician-prescribed sling. We make no claim that it diagnoses, treats, cures, or prevents any disease or condition, or that it keeps casts or dressings dry. Always follow your healthcare professional's instructions before and while using the product. Do not use HydroSling to support your full body weight or for unsupervised swimming. Follow all instructions for protecting casts, dressings, incisions, and surgical areas from water.

2. Who may purchase

You must be at least 18 years old to place an order, or have permission from a parent or guardian who agrees to these Terms on your behalf.

3. Price, payment, and taxes

• All prices are in U.S. dollars. The current price for one HydroSling is $29.97 with free shipping within the United States, unless otherwise stated at checkout.
• Payment is processed securely by Stripe on Stripe's hosted checkout. By submitting payment, you authorize Stripe to charge your selected payment method.
• Sales tax, if applicable, is calculated at checkout based on your shipping address.
• We may correct pricing or typographical errors before we accept your order, and we will give you the chance to confirm or cancel if the correction affects you.

4. Order acceptance and confirmation

Placing an order is an offer to buy. We accept your offer when we send an order confirmation and charge your payment method, or when we ship your order. We reserve the right to decline, limit, or cancel any order, including after confirmation, for reasons such as suspected fraud, product availability, pricing errors, or misuse — in which case we will refund any amount already charged.

5. Shipping

Orders ship from California. See our Shipping Policy for time frames, carriers, and U.S. coverage. Delivery dates are estimates, not guarantees. Risk of loss passes to you when the carrier accepts the shipment.

6. Returns and refunds

We offer a 10-day return window. See Returns & Refunds for full details, including condition requirements, how to start a return, and timing of refunds. Review that page before ordering — it is part of your purchase agreement.

7. Intellectual property

All content on the site — including the HydroSling name, TidalCore name, tagline "Recover. Restore. Rebuild. Perform.," logos, copy, photos, and design — is owned by TidalCore LLC or its licensors and protected by U.S. intellectual-property laws. HydroSling™ is a trademark of TidalCore LLC. You may not copy, reproduce, or use our content or trademarks without prior written permission, except to share a link to our site or to use the product you purchased.

8. User conduct

You agree not to misuse the site — for example, by attempting to interfere with its operation, scraping it at a rate that disrupts service, or submitting fraudulent orders. You also agree not to submit false or misleading information at checkout.

9. Disclaimers

Except as expressly stated in these Terms or in the accompanying warranty on the Returns page, the site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, TidalCore LLC — and its owners, employees, and service providers — will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the site or products, even if we were advised of the possibility of such damages.

Our total liability for any claim arising out of or related to a purchase will not exceed the amount you paid for that purchase. Some states do not allow the exclusion or limitation of certain damages, so some of the above limits may not apply to you — in that case, liability is limited to the smallest amount permitted by law.

These limitations do not affect any rights you have under applicable consumer-protection laws that cannot be waived by agreement.

11. Indemnification

You agree to indemnify and hold harmless TidalCore LLC and its owners, employees, and service providers from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the products in a manner inconsistent with the instructions and safety information we provide.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or related to the site or your purchase will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction. If you are a consumer, mandatory consumer-protection laws of your state of residence may give you additional rights that cannot be limited by contract.

13. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, carrier disruptions, labor disputes, government actions, or internet failures.

14. Severability; no waiver; entire agreement

If a court finds any part of these Terms unenforceable, that part will be limited to the minimum extent necessary and the rest will remain in effect. Failure to enforce a provision is not a waiver. These Terms, together with the pages they incorporate by reference, are the entire agreement between you and TidalCore LLC regarding purchases on the site.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date and will apply to orders placed after that date.
